These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Partner," or "you") and Recast Designs ("Company," "we," "us," or "our"), the operator of the Recast Rewards partner referral platform accessible at recast-rewards.web.app ("Platform").
By creating an account, accessing, or using the Platform in any manner, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Platform.
If you are accessing the Platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
Recast Rewards is a partner referral program operated by Recast Designs. The Platform enables registered partners to submit referrals of businesses that may be interested in web design, mobile application development, or related digital services provided by Recast Designs.

You may use the Platform solely for the purpose of submitting genuine referrals of businesses that may benefit from Recast Designs' services, tracking the status of your referrals, and communicating with other partners through the Platform's community features.

Violation of any prohibited conduct may result in immediate suspension or termination of your account and forfeiture of any unpaid commissions at Recast Designs' sole discretion.
All content on the Platform, including but not limited to text, graphics, logos, icons, software, and the overall design and structure of the Platform, is the exclusive property of Recast Designs or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely in accordance with these Terms. You may not:
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Your use of the Platform is at your sole risk. Recast Designs expressly disclaims all liability arising from your reliance on information provided through the Platform.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RECAST DESIGNS, ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.
IN NO EVENT SHALL RECAST DESIGNS' TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL COMMISSIONS PAID TO YOU IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the above limitations will apply only to the extent permitted by law.
You agree to indemnify, defend, and hold harmless Recast Designs and its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
Recast Designs may suspend or terminate your access to the Platform at any time, with or without cause or prior notice. Grounds for termination include but are not limited to:
Upon termination, your right to use the Platform ceases immediately. Commissions for referrals that have already converted to closed deals prior to termination will be assessed and paid at Recast Designs' discretion, subject to the conditions of the Partner Agreement.
You may terminate your account at any time by contacting us at info@recastdesigns.com.
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Recast Designs operates, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may escalate the matter to binding arbitration or the courts of competent jurisdiction.
You agree to resolve disputes with Recast Designs on an individual basis and waive any right to participate in class action proceedings.
Recast Designs reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify active partners by email.
Your continued use of the Platform after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
